Biden admin preparing executive action to shut down southern border, report says

The Biden administration is preparing an executive action which would temporarily shut down the nation’s southern border, according to PBS NewsHour.

President Joe Biden will reportedly use a section of U.S. immigration law known as 212(f), which gives the president authority to temporarily suspend the entry of immigrants to the U.S. This approach aligns with language included in the most recent bipartisan border measure that failed in the Senate last week.

The order would set a threshold for daily migrant encounters at the southern border and would trigger the border to close if the threshold is exceeded for seven days, according to PBS NewsHour. Daily encounters would reportedly then need to fall below this threshold for the border to reopen to migrants. Unaccompanied children would reportedly be subject to a humanitarian exemption to the order.

The White House could reportedly issue the order as soon as next week, though it has yet to make a final decision. A spokesperson did not respond to a request for comment from The National Desk (TND) Wednesday.

Biden has already employed immigration law suspending the entry of certain migrants at least 16 times throughout his presidency. One such order in February limited the entrance of migrants from the West Bank.

To use the new authority, Biden would reportedly be required to prove the entry of illegal migrants “would be detrimental to the interests of the United States.”

Migrant encounters at the southern border are slowing this month, but the influx has overwhelmed several major U.S. cities over the last year. Speakers at a New York City Council hearing in April pushed for city leaders to accommodate speakers of over 500 indigenous languages, claiming the city had refused to help new arrivals who did not speak English.

Denver city leaders last week approved a $4 million purchase agreement to acquire a former gymnasium building which it is currently using to shelter migrants. The building, according to city leaders, is a “key piece of Denver’s efforts to keep families safely off the streets.” It can accommodate 120 people for “daytime or overnight shelter.”
